1. Definitions

"CONAN" refers to the vessel and the consumer-facing brand. "Operator" refers to Nereis Yachting NEPA (Greek), the current operating entity, or any successor. "Client" refers to any party booking a charter, by the cabin, the boat, or for an ocean crossing.

2. Scope of services

The Operator offers crewed charters on CONAN under three formats — Private Week, Cabin Week, and Transatlantic — across two seasons (Greece in summer, the Caribbean in winter), as further described on this site. Itineraries, dates and routes are indicative and subject to weather, port availability, and the skipper's judgement.

3. The charter agreement (MYBA)

Charters are governed by the standard MYBA Charter Agreement applicable to the vessel and the chosen format, signed between the Client and the Operator at booking. The MYBA framework defines the charter fee, APA, the skipper's authority, and the parties' respective obligations.

4. Booking and payment

Bookings are confirmed upon signature of the MYBA agreement and receipt of the deposit (typically 30% of the charter fee). The balance falls due no later than sixty (60) days before embarkation, unless otherwise stated in the agreement. Payments may be made by card via Stripe Checkout or by bank transfer.

5. Cancellation

Cancellation terms follow the MYBA agreement. Subject to the agreement and where mitigation is possible, the Operator may offer a credit toward a future charter. Where insurance is taken out by the Client, refund handling follows the policy in place.

6. Client obligations

The Client warrants that all guests aboard will respect the vessel, the crew and other guests, follow reasonable safety instructions from the skipper, and refrain from any illegal activity. The skipper retains final authority on all matters of safety and navigation.

7. Liability and insurance

The vessel is covered by standard hull and third-party liability insurance per MYBA requirements. The Operator is not liable for loss or damage to personal property aboard except where caused by gross negligence. Clients are strongly advised to take out personal travel insurance covering trip cancellation, medical expenses, and personal effects.

8. Force majeure

Neither party shall be liable for failure to perform due to force majeure, including but not limited to weather, port closures, public health events, or government restrictions. In such cases the Operator will work in good faith with the Client to reschedule or, where impossible, provide a credit.

9. Governing law and disputes

These terms and the MYBA agreement are governed by the law applicable to the Operator's registered seat at the time of booking. Disputes will first be addressed by good-faith negotiation; failing that, by the competent courts of that jurisdiction. Specific arbitration clauses, where applicable, are set out in the MYBA agreement.
